The attached file contains a proposed rule published in the Federal Register on June 8, 2006 entitled, "Management of Donated Foods in Child Nutrition Programs, the Nutrition Services Incentive Program, and Charitable Institutions." The rule proposes to revise Federal regulatory requirements in 7 CFR Part 250 to ensure that food service management companies under contract with school food authorities (SFAs) credit SFAs for the value of all donated foods received for use in the school food service. The rule would also make other regulatory changes or clarifications, including a reduction in reporting requirements for charitable institutions that receive donated foods, and clarification of the USDA role in providing donated foods in the Nutrition Services Incentive Program (NSIP), in accordance with recent amendments to the Older Americans Act of 1965. The rule has a 60-day comment period, which will end on August 7, 2006.
